The National Emergency (1975–77): Endangered Democracy and Humanism

ABSTRACT
The declaration of National Emergency in India during 1975–77, citing internal disorder as a threat to national security, marked a critical turning point and a dark period for Indian democracy and human rights. This essay analyzes various aspects of the Emergency. It explores the historical background of the Emergency, how fundamental rights under the Constitution were suspended during this period, the curtailment of press freedom, the suppression of opposition parties, and the challenges posed to judicial independence. The essay also explains how these actions affected civil rights, democracy, and human rights in the country. It highlights that the core foundation for protecting the Constitution, and the civil liberties, freedoms, and human rights of the people, lies in a strong and independent judiciary, freedom of the press, a responsible opposition, and a vigilant civil society. To prevent a repeat of such authoritarian and suffocating situations in the future, the essay emphasizes the need to strengthen constitutional safeguards, the rule of law, and democratic values.
